RULES AND REGULATIONS OF SEMESTER SYSTEM IN LL.B. 5 - YEAR COURSE
IN THE FACULTY OF LAW, OSMANIA UNIVERSITY.
(Applicable to be students admitted from the academic year 2001-2002 onwards
for LL.B. 5-Year degree course in Law)

All the rules and regulations, hereinafter, specified shall be read as a whole for the purpose of interpretation.

I. ADMISSION

1. A candidate for admission of LL.B. 5 - Year Degree Course Annual cum Semester course has to qualify at the LL.B. Common Entrance Examination (LAWCET) for that academic year. The candidates will be admitted strictly in accordance with the merit secured at the entrance examination, keeping in view the Rules in force in respect of the statutory reservation of seats under various categories of candidates.

2. No admissions/readmissions/promotions into any year are to be made after the expiry of eight weeks from the date of commencement of instruction for that particular year of 5 Year Degree course. In case there are any court cases consequent upon which the Convener of admissions is obliged to admit any candidates after the last date of admissions, the admission of such a candidate be reserved for the subsequent year on supernumerary basis.

3. A candidate admitted to the LL.B. 5 Year Degree Course will forfeit his/her seat and admission stands cancelled if:

He/She does not put in at least 40% of attendance in 1 year. (OR)

He/She does not secure promotion to Semester V of 5th year within a maximum period of nine years starting from the year of admission. (OR)

He/she fails to fulfil all the requirements and pass all the examinations for the award of the degree as specified, within ten academic years from the time when he/she was first admitted to the LL.B. Course.

 

II. DISCUSSION

i) The Five Years Course of law after 10+2 shall comprise of two parts Viz. Part I which will be a two year core Programme of Pre-law study and Part II which will be a three year programme for professional training in law. The Part I consisting of Pre-law Course is offered under Year Wise Scheme each year consisting of 30 weeks of instruction.

ii) The Part II consisting of 3 Year Professional course is offered under semester scheme. The two semesters in the third academic year are referred to as Semester I and Semester II, the two semesters in the fourth academic year are referred to as Semester III and Semester IV, the two semesters in fifth year are referred to as Semester V and Semester VI. Each semester shall comprise of 15 weeks of instruction.

 

III. AWARD OF DEGREE

i) The LL. B. Degree under 5 Year Degree Course in the Faculty of law will be conferred on a candidates who has pursued a regular course of study for Five academic years as prescribed in the scheme of instruction and has passed all the examinations as prescribed in the scheme of examinations.

ii) A regular course of study for eligibility to appear at the LL. B. Examination shall mean that the candidate should put in attendance of not less than 75% aggregate in lectures in subjects listed in the scheme of instruction. Provided that, in special cases and for sufficient cause shown, the Vice-Chancellor, on the recommendation of the Principal, may condone the deficiency not exceeding 10% of attendance in aggregate on medical grounds when the application submitted at the time of actual illness is supported by a certificate from an authorised Medical Officer, and approved by the Principal. In case condonation in attendance on medical ground is sought the applicant shall pay the prescribed fee.

iii) Attendance at NCC/NSS camps or Inter-collegiate or Inter-University or Inter- State or National or International Matches or Debates, Youth Festivals or Educational excursions if they form the part of the curriculum, or such other Inter-University, Inter-College activities, as approved by the University will not be counted as absence. However, the aggregate of such absence should not exceed four weeks in a year.

iv) In any year of the course, if a candidate fails to secure the minimum required percentage of attendance under the rules, he/she shall not be eligible to appear in the examination of that year, and he/she shall have to seek re-admission to undergo afresh a Regular Course of study of the corresponding year in a subsequent academic year, in order to become eligible to appear in the examination.

v) Attendance shall be reckoned from the date of commencement of instruction as per the almanac communicated by the College/University. The candidate who are eligible for promotion from I Year to II Year shall renew their admission by submitting LL.B renewal application form along with the prescribed fee within the prescribed time. However, in the case of the candidates admitted in LL.B. -I year by the Convener in the subsequent phase of Admission or by Court Order, the attendance will be reckoned with from the date of such late admission.

vi) The Principal shall display cumulative attendance at the end of every month in order to enable the students to know their attendance.

 

IV. SCHEME OF INSTRUCTION AND EXAMINATION FOR PRE-LAW COURSE

i) Instruction in various subjects shall be provided by the College as per the Scheme of instruction and syllabi prescribed.

ii) The programme of instruction, examinations and vacations shall be notified by the Principal of the College/University.

iii) The medium of instruction and examination shall be English.

iv) At the end of each year, University Examinations shall be held as prescribed in the scheme of examination.

v) For LL. B. 1st Year of Pre-law Course, there shall be a supplementary examination.

vi) For LL.B. II year of pre-law course, there shall be an advanced supplementary examination. As Candidates are required to pass all the papers of 2 years Pre-law Course (Part I) to become eligible for promotion to I semester of 3-Years Professional law Course (Part II), one make-up examination of LL.B II Year of Pre-law course as advance supplementary examination will be conducted after the declaration of the results of regular examination, and the results of the advanced supplementary examination will be declared before the commencement of the class of I-Semester of LL.B. III year i.e., Part-II of LL. B. 5 Year Degree Course.

 

V. RULES OF PROMOTION PERTAINING TO PART-I, 2 YEARS PRE-L COURSE / PART-II, 3 YEARS OF PROFESSIONAL LAW COURSE

The candidate should have undergone a regular course of study each of I and II year of Part I and should have passed all the Papers of I and II years of Pre-Law course (Part-I)

 

B.A. Law Degree :

The candidates who have passed 1st, 2nd and 3rd years of LL.B. 5 year degree co from any law college under the jurisdiction of the University will be conferred degree of B.A. (law). However this degree shall not entitle them to seek admission to any post-graduate course or LL.M. degree course in the University.

 

VI. AWARD OF DIVISION FOR PRE-LAW COURSE

a) There shall be a written examination at the end of each year in each subject. In order to pass the examination in the subject the examinee should secure not less than 45% of marks.

b) The classification of successful candidates shall be made separately for Part-I and Part-II. All those candidates who secure 60% or more in the aggregate in the particular part shall be declared to have passed in first class in that part, those who secure 70% or more shall be declared to have passed in First with Distinction. The rest who have secured 45% or more and less than 60% shall be declared to have passed in second class.

c) Division of Award for B.A. law: The candidates who have passed I, II and III years of LL. B. 5 year course shall be awarded division on the basis of the marks secured by the candidates for all the three years and those who se 45% or more in the aggregate and less than 60% shall be declared to have passed in second division and those Who secured 60% and above In aggregate but less than 70% shall be declared to have passed in First division and those who secured more than 70% of marks in aggregate of all the three years shall be declared to have passed in First Division with Distinction.

d) Candidates who have not passed the examinations in the first attempt along with the batch in which they were admitted are not eligible for the award of any Rank/Prize/Gold Medal.

 

VII. IMPROVEMENT OF DIVISION

1. Paper-wise Improvement :

a) When a candidate has passed in one or more papers / subjects in the first attempt in the regular examination(s) (Regular examination means an examination conducted at the end of the academic year for which the candidates were admitted and had undergone instruction) conducted by the College/ University for his/her batch, paper-wise improvement is permissible only in those papers.

b) A candidate is permitted to appear for paper-wise improvement only once for LL.B. I year and once for LL.B. II year examination under Year wise scheme.

c) A candidate who wishes to improve his/her performance may be permitted to do so if he/she appears in the immediate next regular examination conducted by the College/University. Paper-wise improvement is not permissible for any backlog (Backlogs means: (i) the papers / subjects in which the candidate registered for examination but either absented or failed; (ii) papers/subjects for which the candidate has not registered for the examination along with his/ her batch of students) completed paper.

d) A candidate appearing for paper-wise improvement is permitted to have the better of the two awards for the purpose of award of division.

2. Improvement in Aggregate

Improvement in aggregate is permitted only after the candidate passes the degree examination as per the following conditions:

a) Aggregate improvement is permissible only when a candidate appears in all papers/subjects but not piece meal of a year. Further the candidate has to appear for improvement examination as per the scheme of examination and syllabus in vogue at the time of taking his/her examination.

b) When a candidate appears for improvement in an year/years, he/she may be permitted to have the better of the two aggregates i.e., the original or Improvement.

c) The candidate is allowed for improvement in aggregate by appearing not more than two times for any year. Further, aggregate improvement is limited to a period of two (2) years after passing the degree examination.

NOTE I: Candidates who appear for Improvement of performances under any of the above categories are not eligible for the award of Distinction / Prizes / Medals / Merit Certificates etc.

NOTE II: For improvement of Division not more than two chances will be allowed for the entire course of LL.B. 5 year course.

Rules/Regulations/Syllabus, rules or promotion and General Rules of Examination etc., of semester scheme of LL.B. 3-Year Degree course shall be applicable mutatis mutandis to LL.B. III to V Years of 5 Year Degree Course (Except the rules and regulations relating to admission into I-Semester of LL.B. 3-Year Degree Course)
