Mr. Ajay Kulkarni has his own bunglow at Andheri.  That bunglow he has given on rent to Mr. Vijay Deshpande.  Teh bunglow is built 10 year back and according to Kulkarni now it is due for repairs.  However such repair can not be carried out unless the premises being vacated.  So Ajay Kulkarni asked Deshpande to vacate the bunglow to carry out repairs.  Deshpande is not ready for that and did not take any step and did not vacate the bunglow.  Ultimately eviction suit is filed against Deshpande for recovery of possesion of the said bunglow to carry out repairs.  Pls. give me arguments in favour of plaintiff/petitioner and citation.
